Acceptance of Terms

By using our ‘Handwritten’ Mailers Service, you agree to be bound by these Terms and Conditions, which constitute a legally binding agreement between you and us (“SE FSU Inc” dba Pen Letters). If you do not agree to these Terms and Conditions, you may not use our service.

Service Description and Limitations

Our ‘Handwritten’ Mailers Service provides personalized handwritten letters for marketing or soliciting purposes. You will provide us with the content of the letter, the recipients, the recipients address, and your return address. Our service includes ‘handwriting’, envelope addressing, and shipping those letters to you. It is your responsibility to ensure that the data provided is accurate and up to date. We pride ourselves in offering a premium service of cleaning the data, but we make no guarantee of the accuracy of it. We are not responsible for any errors or omissions in the data provided, regardless of whether we attempt to clean it or not. Once we receive your order, we will invoice you for the service based on the number of letters and the content. 

Payment

Payment for our ‘Handwritten’ Mailers Service is due at the time of invoicing. Production of your order will be queued after payment is made.

Intellectual Property

All content provided by you for our ‘Handwritten’ Mailers Service must be original and not infringe upon any third-party rights, including copyrights, trademarks, or patents. We reserve the right to refuse to provide our service for any content that we deem inappropriate or infringing upon third-party rights.

Limitation of Liability

Our ‘Handwritten’ Mailers Service is provided "as is" without any warranties, express or implied. We are not liable for any damages, including but not limited to direct, indirect, incidental, punitive, and consequential damages, arising from the use or inability to use our service.

Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of the State of California, USA, without giving effect to any principles of conflicts of law. Any dispute arising under or related to these terms and conditions shall be resolved exclusively by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

The arbitration shall be conducted in California, USA, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. The arbitration award shall be final and binding, and the parties shall be bound by any award rendered by the arbitrator.

Any arbitration proceedings under this clause shall be conducted on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and we each waive any right to a jury trial.

Modifications to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time without prior notice. By continuing to use our ‘Handwritten’ Mailers Service after any such modifications, you agree to be bound by the modified Terms and Conditions.

Phone Number Provided

A phone number may or may not be provided with the order. If provided, the phone number is intended for sole use with our ‘Handwritten’ Mailers Service. The number will remain active for one year from the most recent order payment date. The phone number is only to be used with our ‘Handwritten’ Mailers Service and not for any other purposes, including but not limited to other marketing or solicitation.

We reserve the right to monitor the use of the phone number provided and if we suspect it is being used for any purpose outside of our ‘Handwritten’ Mailers Service, we may cancel the number without prior notice.

If you require the phone number for a longer period or wish to use it for any other purposes, you must make arrangements with us in writing. Failure to do so may result in the cancellation of the phone number without prior notice.
